TRADING ADDICTION TREATMENT IN NEVADA
It may seem almost counterintuitive for Nevada—the world’s most recognizable gambling jurisdiction—to take such a firm position against prediction markets, but that is precisely what makes the state’s argument so significant. Nevada regulators have consistently argued that sports and other event contracts offered by prediction-market operators constitute wagering under Nevada law, regardless of whether the products are registered with the CFTC. The confrontation began on March 4, 2025, when the Nevada Gaming Control Board sent Kalshi a cease-and-desist letter; Kalshi responded by suing on March 28, arguing that federal commodities law preempted Nevada gaming regulation. Although Kalshi initially obtained a federal preliminary injunction on April 9, 2025, that protection was later dissolved. The battle expanded as Nevada warned Robinhood on May 8, 2025, issued Crypto.com a cease-and-desist letter on May 20, and subsequently pursued Polymarket, Coinbase, and Kalshi through state-court enforcement actions and injunctions in 2026. By April 3, 2026, a Nevada court had enjoined Kalshi from offering prohibited event contracts, and on July 24, 2026, the NGCB announced that Kalshi’s sports-prediction-market business had been shut down in Nevada. Kalshi, meanwhile, has continued challenging Nevada’s authority in court, arguing that its CFTC-regulated event contracts are financial products rather than state-regulated gambling.
Is Nevada Really Fighting Prediction Markets—or Fighting for Its Share?
The financial implications help explain why this dispute matters so much to Nevada. If event contracts remain classified as financial-market products under federal CFTC jurisdiction, transactions conducted through those platforms do not fall within Nevada’s traditional state gaming-tax structure; if the products are instead deemed gambling, they become subject to Nevada’s licensing, oversight, consumer-protection requirements, and taxation system. Nevada’s regulators themselves emphasize that gaming is vitally important to the state’s economy and that licensed gaming is subject to extensive state control. It would therefore be too simplistic to say Nevada’s position is only about tax revenue—the state explicitly cites consumer protection, licensing, integrity, and its longstanding authority over gambling—but the economic stakes are undeniably substantial. The dispute is ultimately about who gets to define these products, who regulates them, and who benefits financially from the activity.
